The signs are film piracy may be on the upswing.
With President Rodrigo Duterte’s intense crackdown on the illegal drugs trade, it looks like film piracy may be back sooner than we think. Not that it had been completely eliminated. It still exists, but not in the scale as during the time of former President Gloria Macapagal Arroyo.
Now that the crackdown has been given less importance such as the non-inclusion of a representative from the Motion Picture Anti Film Piracy Council in the 2016 Metro Manila Film Festival (MMFF) Executive Committee, and the drug lords soon out of business, the tell-tale signs that film piracy will be on the rise are there.
The latest anti-piracy ad directed by Dan Villegas cannot be shown in all cinemas because it was rated PG (Parental Guidance) twice by the Movie and Television Regulation and Classification Board. And to think it just shows a film pirate entering jail with various types of thieves. According to the rules, an ad must be rated G (General) for it to be allowed screening in ALL cinemas.
And there is this exposition on the evils of film piracy on Facebook by Joji Alonso, legal counsel of the Motion Picture Anti Film Piracy Council:
“This post gives us an insight on how cruel and selfish some people have become. It is very much akin to the comment that ‘film producers make so much money anyway, they won’t feel the impact of piracy’ — ergo, no wrong is committed when their work is pirated, when heartless people upload the pirated films and watch them wherever they can, on social media and worse, even brag about it and are jubilant when they get so many views and likes.
“But how many films really make ‘so much money?’ and precisely because not all films make money, shouldn’t the ‘not so lucky ones’ deserve even more protection from piracy???
“A film takes a million man hours to create. The cost of making films goes beyond the money that is put into it. Many of us put in more than the proverbial blood, sweat and tears. For those who refuse to understand — films are the products of our hearts and souls. We give a part of ourselves in every film we make, whether as a producer, an artist, a director, a production designer, a DOP, a composer, an editor, a colorist, a publicist, personal assistants and runners down to the last single personnel or staff who work eight days a week and 36 hours a day — the list is endless, and the damage and hurt, beyond comprehension.
“There is absolutely nothing wrong with hoping that we make a profit out of the films we make. Filmmaking is a gamble beyond par. And to earn from it is neither indecent nor illegal. It is something we deserve. And when you pirate our films, upload and share them, download and watch them, you are cheating us of the pesos and centavos that we would have stood to earn had you not stolen from us.
“Piracy does not need to be defined. It is STEALING. Every person who watches a pirated copy of a film is just as guilty as those who pirated the movie. While it may not be on all fours, this situation is akin to the phrase minted by Justice Felix Frankfurter in the celebrated case of Nardone vs. United States: that whatever has been uploaded without the permission of the creator of the film is ‘the fruit of the poisonous tree.’
“I certainly hope that the people who think like this female specie who posted this on FB will never fall prey to a theft or robbery. Because you apparently are so stuck on yourselves that you do not have the faintest clue of the pain that many of us have gone through or are going through.”
Having stated the above, the Motion Picture Anti Film Piracy Council must be given back its seat in the Executive Committee of the 2016 MMFF before it’s too late — before film piracy rolls into full gear all over again.
